Her attorney, the Rev Alan Bower, said she was arrested at an "unprecedented" time, on Friday night, for refusing to have an abortion. She will spend up to 16 months in jail.

Police said in a statement the women who gave birth at the clinic "were the victims in this situation, and this case has been launched under section 18C of the Crimes Act 1861".

The law states that if two or more women give birth at the same time, any person who provides any false information as to the woman's identity to a police officer shall be guilty of an offence punishable on summary conviction.

"She never would have been arrested if the police had not made inquiries, but they did and this was their investigation, not hers," he said.

During the raid on the clinic on Sunday, a 24-year-old woman told officers she had given birth there but felt forced to have an abortion after she learned she was pregnant.

Police say two women came to their attention after the clinic on Sunday and were charged with providing false identification to identify themselves to the police. A 25-year-old woman and a 32-year-old woman were taken into police custody.

Their charges relate to taking photos and recording the women giving birth at the clinic.

In January last year a 22-year-old student was given two years' jail for lying on to hospital waiting to have an abortion, after telling police she had given birth to a premature baby girl. She admitted to police that her sister was pregnant with her and told them about the incident.

The clinic has been forced to close following the raid.


One clinic, in Southend-on-Sea, which has two branches and has been operating since 2000, and one in London, which has only one branch in London and has operated since 2005, says the raid is "simply outrageous".

"This is all totally false information. There is no such facility in this area and I speak with the staff to see if we can get to the bottom of what has happened," said Jenny Leveson, a clinical assistant.
